Welcome to BeautyCircle!

These Terms of Use ("Terms") constitute a legally binding agreement between you and GoParty Technology Co.,Limited ("we," "us," or "our") regarding your download, installation, registration, sign-in, and use of the BeautyCircle mobile application (the "App").

1. Scope and Definitions

1.1 Agreement Components

These Terms include this document and any rules, notices, or guidelines we have published or may publish in the future (if any), all of which form an integral part of this agreement.

1.2 Definitions

• User / You: Any natural person who registers, signs in, or uses the App.
• User Content: Text, images, videos, audio, and other information you upload, post, or transmit while using the App.
• Services: The features we provide to you through the App (subject to the features actually available in the App).

2. Account Registration and Use

2.1 Eligibility

You confirm that you have full legal capacity, or that you use the App with the consent and guidance of a parent or legal guardian. If you do not meet the foregoing requirements, please do not register or use the App; otherwise, you and your guardian shall bear all consequences arising therefrom.

2.2 Registration Methods

You may create and use an account through registration or sign-in methods we support (such as mobile phone number, email, third-party account sign-in, etc., as displayed in the App). You shall ensure that your registration information is true, accurate, and complete, and update it promptly.

2.3 Account Security

• You shall properly safeguard your account and device and be responsible for all activities under your account;
• If you discover unauthorized use of your account or any security risk, please contact us immediately;
• Without our prior written consent, you may not transfer, lend, rent, or sell your account.

2.4 Profile Setup

After your first sign-in, you may need to set a nickname, avatar, and other information before you can fully use certain features. Some profile fields may be optional and will not affect basic functionality.

3. Services

3.1 Feature Overview

The App primarily provides account management, content browsing and creation, social interaction, instant messaging, audio/video communication, personalized settings, and other features (subject to the features actually available in the App).

3.2 Service Changes

We may adjust, upgrade, suspend, or terminate service content, feature modules, interface design, and other aspects based on business development, technical upgrades, legal requirements, or regulatory policies, and will notify you through reasonable means (except where notification is prohibited by laws, regulations, or regulatory requirements).

3.3 Free and Paid Services

The App is currently offered primarily as a free service. If paid services are introduced in the future, we will disclose pricing and rules separately, and they will take effect only after your confirmation of purchase.

4. User Conduct

4.1 Lawful Use

When using the App, you shall comply with the laws and regulations of your country or region and the provisions of these Terms, and shall not use the App to engage in any unlawful or improper conduct.

4.2 Prohibited Conduct

You shall not engage in conduct including but not limited to the following:

1. Posting or disseminating content involving violence, terrorism, gambling, drugs, political sensitivity, religious extremism, discrimination, defamation, harassment, infringement, or other illegal or non-compliant content;
2. Disclosing sensitive personal information of yourself or others, such as ID numbers, bank card numbers, home addresses, or phone numbers;
3. Impersonating others or falsely stating your relationship with any individual or entity;
4. Using the App for fraud, pyramid schemes, advertising harassment, or spam;
5. Uploading content containing viruses, trojans, or other malicious programs;
6. Unauthorized access to, interference with, or disruption of the App or related servers or networks;
7. Using automated programs, crawlers, or other means to scrape data in bulk or interfere with normal operation;
8. Circumventing, disrupting, or attempting to circumvent content review, reporting, blocking, or other safety mechanisms;
9. Other conduct that violates public order and good morals or infringes the lawful rights and interests of others.

4.3 Content Standards

Content you post shall comply with community guidelines, including but not limited to:

• No nudity, sexual innuendo, or vulgar content;
• No incitement of hatred, discrimination, or personal attacks;
• No infringement of others' portrait rights, copyrights, trademarks, privacy rights, or other lawful rights and interests;
• Content must not be used for misleading, fraudulent, or unlawful purposes.

We may take measures such as warnings, feature restrictions, content removal, account suspension, or account termination against content suspected of violations, and report to competent authorities as required by law.

4.4 Reporting and Blocking

You may protect your rights through reporting, blocking, and other features provided in the App (if available). We will handle related requests reasonably, but do not make substantive commitments regarding all outcomes. For content that is clearly illegal or non-compliant, we will cooperate with handling as required by law.

5. User Content

5.1 Ownership

You retain the rights you lawfully hold in User Content. By uploading or posting User Content, you represent that you own the corresponding rights or have obtained lawful authorization, and grant us a worldwide, non-exclusive, sublicensable, royalty-free license to store, use, reproduce, modify, distribute, and publicly display such content as necessary to provide, display, promote, improve the Services, and maintain security (limited to what is necessary to deliver the Services).

5.2 Responsibility

User Content represents your personal views only and does not represent our views. You shall independently be responsible for the legality and authenticity of User Content and bear all legal liability arising therefrom.

5.3 Content Processing

We may, but are not obligated to, review User Content. If content violates these Terms or applicable laws, we may delete or block it without notice and take account restriction measures depending on the circumstances.

6. Intellectual Property

6.1 Our Rights

The App and all software, interface design, logos, trademarks, text, images, audio, video, materials, documentation, and other content contained therein are owned by us or relevant rights holders and are protected by law.

6.2 Restrictions

Without prior written permission from us or the relevant rights holder, you may not:

• Copy, modify, distribute, sell, or rent the App or any part thereof;
• Reverse engineer, decompile, or disassemble related software (except as expressly permitted by law);
• Remove or alter copyright notices, trademarks, or other proprietary identifiers in the App.

7. Third-Party Services

The App may contain or link to services provided by third parties (such as third-party sign-in, cloud communication, payment, etc.). Third-party services are operated by their respective providers. When using third-party services, you shall comply with their terms of service and privacy policies. Disputes arising from third-party services shall be resolved between you and the third party, and we disclaim liability to the extent permitted by law.

8. Privacy

We value your privacy. For the collection, use, storage, and protection of personal information, please see the BeautyCircle Privacy Policy. These Terms and the Privacy Policy together constitute the complete agreement between you and us.

9. Account Deletion

You may apply to delete your account in the App. After submitting a deletion request:

1. We may apply a 30-day cooling-off period. If you sign in again during the cooling-off period, it will be treated as cancellation of the deletion request;
2. After the cooling-off period expires without cancellation, we will delete or anonymize your account information and User Content (except where retention is required by laws and regulations);
3. After deletion is complete, you will not be able to restore your account or related data.

10. Disclaimers

10.1 As-Is Basis

The App is provided on an "as is" and "as available" basis. We will endeavor to maintain stable service, but do not guarantee uninterrupted, error-free service or that the service will fully meet your specific needs.

10.2 User Content and Third Parties

We make no express or implied warranties regarding User Content or third-party services. You assume the risks arising from reliance on User Content or third-party services.

10.3 Force Majeure

We disclaim liability to the extent permitted by law for service interruption or data loss caused by force majeure or reasons beyond our reasonable control, including natural disasters, war, strikes, government actions, network failures, hacker attacks, or technical adjustments by telecommunications authorities.

11. Limitation of Liability

To the maximum extent permitted by law:

1. We shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the App;
2. Our total aggregate liability to you shall not exceed the amount you paid us directly for the Services giving rise to the claim in the twelve (12) months preceding the claim (if any); if you paid nothing, the cap shall be USD 100 (or equivalent local currency), unless applicable law prohibits such limitation.

Nothing in this section affects liability for personal injury caused by our intentional misconduct or gross negligence, or other liability that cannot be excluded under applicable law.

12. Changes and Termination

12.1 Changes to Terms

We may revise these Terms. Material changes will be communicated through in-app notices or other reasonable means. If you continue to use the App after changes take effect, you will be deemed to have accepted the revised Terms. If you disagree, you shall stop using the App and delete your account.

12.2 Termination

We may suspend or terminate the Services provided to you and delete your account as appropriate in the following circumstances:

1. You violate these Terms or applicable laws and regulations;
2. As required by government authorities or judicial organs;
3. For security reasons or other necessary circumstances;
4. You have not used your account for an extended period (the specific period is subject to in-app rules).

After termination of the agreement, provisions regarding intellectual property, disclaimers, limitation of liability, dispute resolution, and other provisions that should survive by their nature shall remain in effect.

13. Minors

If you are under 18 years of age, please read these Terms with your parent or legal guardian and use the App only with their consent. Guardians shall guide minors in the proper use of the internet and bear corresponding supervisory responsibilities.

14. Governing Law and Dispute Resolution

14.1 Governing Law

The formation, effectiveness, interpretation, performance, and dispute resolution of these Terms shall be governed by the laws of the Hong Kong Special Administrative Region (excluding conflict-of-law rules), unless mandatory laws in your jurisdiction require the application of other laws.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in Hong Kong in accordance with its then-effective arbitration rules. The arbitral award shall be final and binding on both parties.

15. Miscellaneous

1. Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect.
2. Headings: Section headings are for convenience of reading only and do not affect the meaning of the provisions.

The English version of these Terms is provided for convenience. In case of any inconsistency with other language versions, the Chinese version shall prevail unless otherwise required by applicable law.
